If he rejects it, solely, it can come up again. This way it will never come up again because the highest court as ruled that it has no grounds. |

Persistent concerns about the qualifications of both major party candidates rank among the oddest aspects of 2008's historic campaign.
Article II, Section 1 of the Constitution provides that "No person except a natural born citizen" is eligible to be president. John McCain's status was questioned because he was born in the Panama Canal Zone and various theories have been advanced to cast doubt on Obama's.
Lawsuits over the inclusion of their names on state general-election ballots popped up around the country and were quickly dispensed with by local courts. But two challengers have pursued their cases to the Supreme Court.
Pennsylvania lawyer Philip Berg claims that the circumstances of Obama's birth are vague and that he may have been born in Kenya. Obama's mother, Berg asserts, later flew to Hawaii to register the birth.
Leo Donofrio, a New Jersey lawyer, contends that election officials in his state failed to ensure that only legally qualified candidates were placed on the ballot. Obama may have been born in the United States, Donofrio argues, but "natural born" status depends on both parents being American citizens. Obama's father was Kenyan.
The justices are unlikely to take up these cases for a host of reasons, not the least of which is the invitation to overturn the results of an election in which more than 66 million Americans voted for Obama. An equally high hurdle is the issue of whether Berg or Donofrio have the legal right to sue claiming a violation of the Constitution.
In dismissing Berg's complaint, a federal judge in Pennsylvania found that he failed to meet the basic test required for sustaining a lawsuit, because he couldn't show how the inclusion of Obama's name on the ballot would cause him -- apart from others -- some particular harm. Berg's stake, the judge said, "is no greater and his status no more differentiated than that of millions of other voters."
Other courts presented with similar challenges have reached the same conclusion, ruling that there is no general legal right to sue over the Constitution's eligibility requirements. Federal courts typically reject claims of legal standing based simply on a litigant's status as a voter or taxpayer.
The Obama campaign had hoped to end the controversy last spring by releasing his actual Hawaii birth certificate. But that prompted further questions about its authenticity, which were compounded when state authorities in Hawaii said they could not vouch for it, because they were constrained by the privacy laws.
Then, on Oct. 31st, the director of Hawaii's Department of Health issued a statement, proclaiming that he had personally seen and verified that the state has "Sen. Obama's original birth certificate on record," which shows that he was born there. |

A child born outside of the United States to one U.S. Citizen parent and one non-U.S. Citizen parent, may be entitled to citizenship providing the U.S. Citizen parent had, prior to the birth of the child, been physically present in the United States for a period of ten years, at least five years of which were after s/he reached the age of fourteen.
Anyone who would try to challenge his citizenship is pretty much bored to death.

DEFINITION OF TERM "NATURAL BORN CITIZEN" FROM WIKIPEDIA.COM:
The United States Constitution requires that Presidents (and Vice Presidents) of the United States be natural born citizens of the United States. While it is undisputed that people born in the US are qualified to hold the office of
President, and that naturalized U.S. citizens are disqualified from holding that office, it is disputed whether people born to US-citizen parents outside the United states are natural born citizens or not.[1]
The constitutional provisions
The special term "Natural Born Citizen" is used in particular as a requirement for eligibility to serve as President or Vice President of the United States. Section 1 of Article II of the Constitution contains the clause:
“ No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States. ”
Additionally, the 12th Amendment to the Constitution states that: "[N]o person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."
The Fourteenth Amendment to the United States Constitution provides an additional source of constitutional doctrine stating that birth "in the United States" and subjection to U.S. jurisdiction at the time of birth, entitles one to citizenship:
“ All persons born or naturalized in the United States and subject to the Jurisdiction thereof, are Citizens of the United States and of the State wherein they reside. . . ”
However, the full text of the fourteenth amendment does not mention the phrase "natural born citizen," nor does it address Presidential qualifications. The phrase "natural born Citizen" is not defined anywhere in the Constitution, as is true with most Constitutional terms.
Section 8 of Article I confers on Congress the power "to establish a uniform Rule of Naturalization..." This power has been construed to include defining the characteristics of a "natural born citizen", as well as the conditions of "naturalization".
The 1790 Congress, many of whose members had been members of the Constitutional Convention, provided in the Naturalization Act of 1790 that "And the children of citizens of the United States that may be born beyond the sea, or out of the limits of the United States, shall be considered as natural born citizens." In addition George Washington was president of the Constitutional Convention and President of the United States when this bill became law. If Washington disagreed with this definition, he could have vetoed this bill. However, in 1795 the Congress passed the Naturalization Act of 1795 which removed the words "natural born" from this statement to state that such children born to citizens beyond the seas are citizens of the U.S., but are not legally to be considered "natural born citizens" of the U.S. This was done to clarify for those living at that time who was and who was not a "natural born citizen" per the framers intent at that time, since the 1790 Act had introduced confusion into that subject in regards to the use of those words in the Constitution. George Washington was also President in 1795, and thus he was aware of this change. And if he disagreed with the clarification and change in the wording in the new act in 1795, he would have vetoed the Naturalization Act of 1795.

I have read through all of that information. That is the whole problem, it is left up to interpretation. Those same interpretations are what sparked the Dred Scot case and the Civil Rights Movement of the 50's and 60's.

Obama did not present the proper documentation to the senate. according to what i have been reading he produced a birth certificate via his campaign which in turn went online..this process prompted suspicion and made it appear as though he had something to hide. I think ya'll [EXPLETIVE] are silly. This issue of his citizenship came up at the very beginning of his announcement that he would run. It even came up for McCain. But the constitution states that you can not be a president not that you can not run. I think Barack is a good guy, definitely the best of the people who made it through the "primaries" but not the best person who ran...and if you didn't vote in the the "primaries" you probably don't understand the process well enough to comment. I think people should make sure the Constitution is upheld, remember Barack doesn't want anyone to have any guns, neither does Biden, these are Constituional rights. I took the time to research other candidates. I voted for McKinney. So many people didn’t even know that other candidates were running. They let the media dictate everything to them. Some one even mentioned McKinney wasn’t on the ballot in their home state but a knowledgeable person would know you can write in a candidates name on a ballot.
So many people became so caught up in the hype of having a “black president” I don’t think they were paying attention to where he stands on a lot of the issues. Add to that the fact that we are all so tired of Bush, a Giraffe could have run and won if it meant no more Bush. |

The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.
The governor's office in Hawaii said he had a valid certificate but rejected requests for access and left ambiguous its origin. Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii.
Obama's half-sister, Maya Soetoro, has named two different Hawaii hospitals where Obama could have been born.
But a video posted on YouTube features Obama's Kenyan grandmother Sarah claiming to have witnessed Obama's birth in Kenya.

Dear friend of Liberty,
This past presidential season I saw a renewed enthusiasm from our country’s youth.
An excitement for liberty gripped the college campuses unlike I have ever seen before. Young people were energized for real change.
Still to my amazement, our college rallies attracted thousands of young people. Students were hungry for the message of freedom, peace, and prosperity.
For this reason, a youth-based movement for liberty is essential to our cause. It is these young men and women who will become tomorrow’s champions of liberty.
That's why I am giving my enthusiastic endorsement to Young Americans for Liberty (YAL); an organization that is built directly on the success of Students for Ron Paul.
My National Youth Coordinator, Jeff Frazee, is launching this organization with an ambitious goal of starting over 100 campus chapters in 2009. They have already started 47 chapters this semester.

I do believe Obama was born in Kenya. Someone told me that Obama's mother was 18 when he was born. The other part of the law you posted "allegedly" says she needed to be 19 for her child to be a US citizen. This is the source of all the controversy. That link you provided is for a certificate of birth and it was made available during the campaign by his aids, on his websites..etc..
I voted for Obama..and could care less..but the argument has been raised, and you have to be fair.. over 100,000 people signed a petition to see something a little more ligitimate than this certificate of birth. They are ssying that the authentic document can be requested by him through vital records at a cost of 12.00. He should present that to the courts or the United states senate, the same way that the other presidential candidates did, and this will shut down the argument..as it did for the others. the question is ...why won't he do that? this is why the controversy is ongoing... and getting out hand! I see nothing wrong with being sure, so that blacks and americans as a whole...won't stand to be even more embarrassed down the road. |

He was the first Black editor of the Harvard Law Review, and that can't happen if you are not attending the school. But as with all of us, our records are sealed and private, and therefore, no one should be able to walk up to the registrar and ask to see them. If you want to see them, get the court order and permission, pay the fee, and be happy with that.

The issue doesn't have to do with whether Barack Obama is a citizen, but a NATURALIZED citizen. That means he was actually born in the United States. If you are born in another country, you are a U.S citizen automatically, but not considered "NATURALIZED". I just wanted to provide some clarification, even though I personally think this is Custer's Last Stand for racist Whites and self-loathing Blacks to keep the White House "White". I do see a huge double standard, as John McCain was born in Panama. The "McCainers" claim, that because he was born at a military hospital in the Canal Zone, located in a U.S Military installation, he is thereby considered a "NATURALIZED" citizen, since a foreign military base is considered an extension of the United States. To me, that makes him a U.S citizen, but not a NATURALIZED citizen. To my knowledge you have to be born in the actual United States to be considered naturalized. U.S Territories (i.e Guam) and foreign military bases are a stretch, since you weren't born in an actual state. Hawaii is a state, the Canal Zone in Panama is a territory.
All I have to say is this, if this shyt starts to snowball and the U.S Supreme Court overturns his elections, race relations between Whites and Blacks will never recover, please believe that. That shyt would be the final straw!!! Sure, the millions of Whites that voted for him would be angry and pissed too, but this would be the final wakeup call to Blacks, that this system of White Supremacy will always do a Black man/woman dirty and use loopholes and their laws to keep a boot on their neck. Basically, what happened was, our local DJ broke it down on the radio..basically saying that they booked these ladies as last minute picks. they almost did not go ahead with them.,,but none of the really wealthy women would do it. He went on to say that they had even asked his wife..and she said no. Many of the wives could not do it because their husbands said no. (call it a southern thing) anyway the Atlanta area was not represented well at all. the really affluent women are private and professional and simply did not want their business out there based on how these reality shows edit and embellish things. the ladies that agreed to do had something to gain..for example SHeree and Lisa wanted to promote their business which is why they agreed. |

In my humble opinion it is not up to Obama to prove that he was born in the U.S. It is up to his detractors to prove that he wasn't. When you are a new born you are not aware of anything around you. You could be told that you were born on the moon. How would you know any differently. There is no way Obama can verify something that that was the result of himself being born. Show evidence that he was born elsewhere and then get back with me. |

The person who originally submitted the petition actually submitted to remove Obama ( had a dual citizenship US & Britain), McCain ( Born in Panama Canal Zone when it was in US possesion )and the person who ran for the Socialists workers party ( he was born in Nicaragua) candidate as well. this petition was killed so he went and sent it to the justice in his area and his petition was killed there as well. Legally he can resubmit it to another justice and resubmitted it to Thomas, of course Thomas could have turned down his petition BUT then he could have just resubmitted to another justice.
Pundits are thinking Thomas has submitted to his co- justices more to HAVE EVERYONE VOTE THE PETITION DOWN THEN PERMENANTLY KILL THE PETITION 4EVER ,that way we dont have to hear from this guy ever again

He was raised by his grandparents becuase his mother couldn't raise him, it could have gotten mixed up in all the craziness back in the day. I took the time to research other candidates. I voted for McKinney. So many people didn’t even know that other candidates were running. They let the media dictate everything to them. Some one even mentioned McKinney wasn’t on the ballot in their home state but a knowledgeable person would know you can write in a candidates name on a ballot.
So many people became so caught up in the hype of having a “black president” I don’t think they were paying attention to where he stands on a lot of the issues. Add to that the fact that we are all so tired of Bush, a Giraffe could have run and won if it meant no more Bush.”
Where in that statement did you get,” fire4u or stormzoe said”? There are a lot of people that I have communicated with both on and off line that were not aware anyone else was running besides Obama and McCain, including members of my own family.
For the record, Cynthia McKinney petitioned to debate both Obama and McCain but because the Democratic and Republican parties are just flip sides to the same coin and have their hands in the pockets of the major networks, it didn’t happen. They know she would have asked the real questions just as she has in the past when it comes to 9/11 and Hurricane Katrina and she will continue to do so. McKinney was going to call for the impeachment of both Bush and Chenney.
There are a lot of people both on and off line that were not aware you can write in a candidates name on a ballot. If you were aware of that, then congratulations to you. You have a little more knowledge than most. That was not a “cheap shot” as you called it or my way of “coming at you” for not voting for McKinney. You are free to vote for whom ever you want to vote for. You say you were able to relate to Obama and I was not.
The fact of the matter is, a lot of people did vote for Obama just because he is of Kenyan heritage. My own uncle who sadly had never voted before a day in his life only registered and voted because Obama was running and it nothing to do with the issues, it was all about skin color.
Because I did take the time to research Cynthia McKinney and where she stood on different issues, my vote was not based on skin color.
And for the record, saying I look like McKinney is not an insult to me. She is attractive in my opinion not to mention, highly educated and opinionated. |

Obama Born In Kenya? His Grandmother Says Yes
Someone is lying. According to Obama's Kenyan (paternal) grandmother, as well as his half-brother and half-sister, Barack Hussein Obama was born in Kenya, not in Hawaii as the Democratic candidate for president claims. His grandmother bragged that her grandson is about to be President of the United States and is so proud because she was present DURING HIS BIRTH IN KENYA, in the delivery room. -This, according to several news sites and Pennsylvania attorney Philip J. Berg (see video below) who is, surprisingly, a life long democrat himself. Berg is the former Deputy Attorney General of Pennsylvania, and he has an impressive background in his activities as a democrat, but his support for the party seemingly stops when it comes to his trust in Barack Hussein Obama.
Many U.S. voters are suspicious of the Democratic candidate's past, and Berg filed a lawsuit to force Barack Hussein Obama to produce a certified copy of his original birth certificate to prove that he can run for the office of President of the United States. However, he is being fought. The DNC On Sept. 24 filed a motion to dismiss the Berg action. Why? What is there to hide? Why not produce the original birth certificate and be done with all the suspicions against Barack Hussein Obama?
A few months back, a birth certificate WAS posted on the internet which shows that Obama was born in Hawaii. Yet some say this birth certificate is a forgery and again, his grandmother states that she was present at the birth, in Kenya. So what is the truth?
One explanation is that Obama's mother Ann Dunham, flew to Kenya in 1961 with Obama's father to meet his family. According to some news reports, Ann Dunham, was not accepted well by her husband's family because she was white:
"Obama's family did not take to Stanley Ann Dunham Obama very well, because she was white, according to Sarah Obama. Shortly after she arrived in Kenya Stanley Ann decided to return to Hawaii because she later said, she did not like how Muslim men treated their wives in Kenya. However, because she was near term the airline would not let her fly until after the birth of her baby. Obama's grandmother said the baby—Barack Hussein Obama, Jr.—was born in Kenya and that shortly after he was born, Stanley Ann returned to Hawaii."
However, by the time she wanted to leave Kenya, it was during the late stages of her pregnancy. She was not able to board a plane because the airlines wouldn't allow women so close to birth to fly. It is instead believed, that Barack Hussein Obama was born in Kenya as his grandmother apparently stated. Then, after he was born, his mother returned with him to Hawaii where his birth was REGISTERED on or about August 8th, 1961, in the public records office in Hawaii.
There is also a discrepancy in what hospital Barack Hussein Obama was born in, even if he was born in Hawaii. Reports by his own sister in two separate interviews state that he was born at two different hospitals-- Kapiolani Hospital and Queens Hospital--in Honolulu.
The Times Herald even reports: "the senator's grandmother, brother and sister, who live in Kenya, believe they were present during Obama's birth in the African country." Here, the Times Herald uses the word that his family 'believe' he was born in Kenya (perhaps to avoid possible law suits by Obama's Truth Squad?).
I myself, not wanting to believe what I see, did some searching around, and this is what I came up with:
Obama was born on August 4, 1961, at the Kapiolani Medical Center.
and here it says:
Barack Obama was born at the Queen's Medical Centeron 4 August 1961.
So which hospital was it, or was he really born in Kenya? And why is this simple matter so confusing and disturbing? Do the search your self and plug in these key words:
Obama born Queen's Medical Center and then Obama born Kapiolani Medical Center in a Google search. You will see he is reported to be born in two diferent hospitals. A miracle! Maybe he IS the Messiah (grin).
What's so hard about knowing something so simple as which hospital or country someone was born in? And if it is simple, then why doesn't Barack Hussein Obama just present the court with his original birth certificate to be analysed and proven? Why would his mom do that? It's obvious... so he could enjoy the rights and privileges of being a US citizen. So he grows up believing he's a citizen... As for Obama's Kenyan family, his father had so many children and wives that his grandmother probably can't remember which birth she attended. That man loved to make babies and have wives and abandoned them all!
With Obama's father being in Hawaii in school then abandoning them when he was only 2, I don't believe for a minute his mother got a chance to spend any time in Kenya. |

The show also went to Indonesia to track down records of his enrollment. He was listed under his stepfather's last name. A classmate and former teacher spoke about him.
Then they went to Hawaii and that's where they discovered the bulk of his teen life.
For you to say there is no footprint of this man is erroneous and you see what you want to see.

... and just to clear up some possible confusion, the Constitution does NOT require Representatives or Senators to be NATURAL BORN citizens of the USA. Only the offices of President and Vice-President have that restriction. To be a Senator, you only have to be a NATURALIZED citizen who has lived in the USA at least seven years (and you have to be 30 years of age or older). A Representative must be at least 25 years of age and have been a NATURALIZED citizen and resident for at least five years. So just because Obama was elected to the US Senate does NOT mean that anyone would have needed to question his citizenship, since he is/was indeed NATURALIZED in 1961. |

In closing i will say...defining natural born citizen as it is outlined in the constitution is very complex because our forefathers were not very clear. some say it means born in the usa ..while others believe one or both parents are citizen thus
AS I said....John McCain, was born to Navy parents in Panama. but because it was on American territory, like Guam and Puerto Rico scholar and expert said it was ok in the end per the the U.S. Senate resolution examination of his birth certif and the laws at that time. OBama never cooperated in the way that McCain did..never produced the authentic certificate, and never went before the senate.
But any way, in the end, like i said , the champagne is chlled, the roast duck is on the menu, the inauguration is in full effect, so the Supreme Court is likely to say Mr. Obama's birth was OK, too. Mr Obama has been arrogant and suspect.. about the matter (is my main point),
