I'm not an expert either, but I know that an auction always takes place on the steps of the local courthouse. If a person does not pay their mortgage, then the lender forecloses. If taxes are not paid, then the city or county where the property is located then puts a lien on it. That's why I am confused by this so "proof" MTO has.

Fantasia is still with J Records, she only changed management. SHe is now managed by BD Management, and they have been quite good.

Poor Fantasia. I don't know how she will get out of this mess, because the paper work says that they will auction her house in Jan of 2009. If I were in her shoes, I would just down size. to your point concerning jobs, i really, really, really wish folks would consider going into business for yourself especially given the current environment. we all know that we are the last hired and first fired. there are so many resources out there to help get us off our feet but we just have to put the effort into finding them. if anyone is intersted in doing just that i would suggest setting up an appointment with your local sbdc or ptap. i also suggest to look outside of traditional methods such as monster, careerbuilder, hot jobs etc. try nontradional approaches like trade shows or networking events. i attended a womans business roundtable the other day and made some great connections. i wish the best for everyone!

The million dollar home that is up for auction is not from a foreclosure but a product of bankruptcy (there is a difference)...the house is over $14k in property taxes arrears. Donald Trump's business entities have filed bankruptcy several times over and nobody questions his wealth or his financial decisions.
If anything this is a testament to celebrities to not let everyone control your business transactions (the property tax information is sent to Will.i.am Global in Sherman Oaks, CA...while the other home's property tax statement goes to the actual home and has a $0 balance with Mecklenburg County). When it comes down to it they're the ones that end up in court like Michael Jackson or going to jail like Wesley Snipes and quite a few other celebrities. based on the comments i don't beleive she is losing her home. if we are to believe some of the commenters the consultant that she hired to handle her accounting didn't do his/her job. in most states you can stop auction preceeding at anytime by becoming current on your taxes. 14k is like 5 bucks to her so i'm sure she will put a stop to it. but it does bring up a few couple of points.
1. she could have gotten around the problem by having the taxes added into her mortgage monthly payment. that would seem to of been the easiest solution to me.

This could possibly be a lien placed on her for the back taxes owed. In which case, an actual foreclosure would not take place until after a later date. It states on this notice that she has until January 9,2009 , which leads me to believe that this is not a forclosure , but a lien.. which is a legal claim against your property for back taxes. If she does not pay this, foreclosure could take place. It appears to me that she simply has allowed someone else to handle her affairs while traveling and being on the road. She is on tour right now, I believe with Ricky Smiley..or she recently was. Hopefully she will take care of this very personal matter. Of course , do not depend on MTO for and update on the good news if she resolves this. Rest assured they likely will not retract or update.

that is correct sweetie. HOWEVER, a homeownver still has to PAY the back taxes while contesting, or the city or state STILL HOLDS THE RIGHT to act...or move ahead with a lien sale.

When you loose your house in a foreclosure the bank is the Plaintiff not the State. Alot of rich people are going through this, its all due to subprime and preditory lending. I'm not trying to burst anyone's bubble nor start a posting "war," (I'm an informed homeowner not a real estate agent or broker) but all home mortgages don't have escrow accounts set up to pay their property taxes. If we're going to state things as facts let's at least get it correct. Home buyers, much like myself, can elect to pay an additional amount with the regular mortgage payment that goes into an escrow account and automatically pays our property taxes annually (and in my case it pays the homeowner's insurance premium too). Typically this is required with home loans are backed by the government (Fannie Mae, Freddie Mac, FHA) but regular home buyers can elect to have it because it's everything rolled into one payment and automatically pays each bill annually. I'm a bit surprised that reputable real estate agents (that's slightly disturbing) and homeowners who are posting here from North Carolina don't know this. Another inaccurate "fact" that has been floating around is that one's home isn't subject to foreclosure if property taxes aren't paid (at least in the state of North Carolina). If property taxes are unpaid a lien can be put on the home and if not taken care of at that point a home can most certainly be put into foreclosure. The same applies for homeowners association assessments.
There may be variations based on your state but in the State of North Carolina the above are facts....look them up.
Opinion-wise I do think that it's very unethical for someone that is entrusted with private information to snitch to gossip sites; that's an automatic pink slip in most areas of business. And I also think that we shouldn't be surprised of anyone having a hard time with state of the global economy. It didn't happen overnight and it's not going to be rectified overnight....we just need to stay prayed up and know that at the end of the day a house and all of these other things are just material objects and doesn't define who we are as human beings. Also, I know this is a gossip site but must we always tear each other down? Regardless of Fantasia's status now she is still blessed and is probably in a better position now than when she auditioned for American Idol. But then again that's my two cents.

************ i somewhat agree with you and if you read my posts,(which i only posted as a concerned fan)not a realtor.. please note that i already clearly pointed out that this was likely a lien due to unpaid property taxes of some sort. I am a homeowner as well, (in Atlanta) and your point regarding the escrow account has already been pointed out ,,by Placidity., No one ever quoted or pointed out the specifics as to whether Fantasia had an escrow account set up or not. Personally, I pay my property taxes annually, and they are NOT included in my mortgage. If she is behind in property taxes, then her mortgage may have been set up in a similar manner. Also, The person identifying themself as a realtor working for the mortgage company posted public information. Although, i too disagree with exposing that type of information MTo set the stage for anyone to research this document and the information is on both zillow's webpage as well as the local Charlotte sheriffs office web site. I commend those who did thier own research.

To be perfectly candid fanfare I wasn't talking to you specifically...I'm not trying to tear anyone down; I was merely stating the relevant facts vis-a-vis the state of North Carolina, foreclosures from property tax arrears liens, mortgage-based escrow accounts for taxes and insurances, et cetera. As well as stating my OPINION on the ethics of one revealing confidential information (whether Fantasia is paying her mortgage) to gossip blogs. I can speak from my perspective in corporate & investment banking perspective; you sign a confidentiality agreement and can be held liable for revealing confidential information. Any information that you obtain from your place of employment that you would not be privy to if you didn't work there is confidential...if you don't know, ask Martha Stewart...ask the hospital worker in California who was fired for revealing medical information about Britney Spears. But again...that is just my final 2 cents on this subject.

I live in the same city as Fantasia. She has 2 homes here. 1 for 1.3 million 7500sqft the other 750,000 4500sqft that isnt in foreclosure. Hate to rain on your negative parade MTO commenters. But she simply made a sound finincal and humble decision to let the bigger home go. She used to be here out and about all the time. As she got busier her presence of course died down and is rarely around. Why wouldnt she free up some money and skip that mortgage in this economy. Who wants to experience the very public process of foreclosure? The way the banks are looking right now I wouldn't blame her if For all the ppl calling her hood and ghetto so what if it is shoebox/mattress money. At least she got it. Where is yours?
