people in the entertainment industry get in way over their heads. these musicians get all gassed and excited when they get a record deal, make a few songs with a couple of famous people, and all of a sudden theyre buying houses and cars and shopping at expensive stores off the bat. that money dries out if you dont have steady work flowing in. getting 30G's to write a song or do a show aint sh*t if youre planning to buy a house or car. you need to write 100 songs first before you even think about making a big purchase. and if you have a husband thats not helping, thats just leeching off of you and the little money youre bringing in, youre f*cked. what did she expect. these banks arent playing anymore, theyre not putting up with deadbeats like they used to. *this is always due to people living beyond their means. you dont have to live a flashy life to live beyond your means. if you dont have savings and and a healthy supply of money steadily coming in, you f*ck yourself up if you begin to rely on loans and credit to make big purchases. perhaps renting an apartment was more along her means rather than buying a home. people dont think about maintaining the home, they just think about the initial downpayment and when they have enough money for that, they jump on it. then the property taxes and maintenance of the home creeps up on them along with the mortgage and other assorted household bills and they fall into a hole. taking a loan out is not like getting free money. you eventually have to pay it back and the govt doesnt care if you fall upon hard times, they want their money. |

Governor O'Malley Announces Agreement with Mortgage Servicing Companies to Provide Foreclosure Relief
ANNAPOLIS, MD (November 7, 2008) – Governor Martin O’Malley today announced that after intensive negotiations, Maryland has reached agreements with six mortgage servicing companies to create a streamlined and transparent loss mitigation process for distressed Maryland homeowners. Together, these companies service 23% of home loans in Maryland. The Governor was joined today in Annapolis by Department of Labor, Licensing and Regulation Secretary Thomas E. Perez, Department of Housing and Community Development Secretary Raymond Skinner, Financial Regulation Commissioner Sarah Bloom Raskin and representatives from the participating servicers.
“During this time of economic uncertainty, we must do all that we can to protect our middle class families and keep our families in their homes,” said Governor O’Malley. “I want to thank these six lending companies for taking the lead in their industry, and becoming part of the solution for distressed homeowners in Maryland.”
The agreements follow a five-point framework that will provide Maryland homeowners direct access to servicers through Maryland’s Foreclosure Prevention Assistance Network. By signing the agreements, the servicers, HSBC, Ocwen, GMAC ResCap, Litton Loan Servicing, AmeriNational Community Services and Citi, have pledged to abide by a predetermined timeline for loss mitigation that will ensure homeowners have an answer within 75 days from the time they submit a loss mitigation package. The agreements also ensure that generally during that time, the lender will halt foreclosure actions and penalties will not accrue. The servicers agreed to designate representatives, known as “Team Maryland,” who will serve as the direct points of contact for Maryland assistance network working with distressed homeowners. The servicers have also agreed to establish or continue internal policies that offer staff incentives for loan modifications, and to refrain from offering incentives that encourage foreclosures.
“Maryland has been at the forefront of creating policies and reforms to combat the foreclosure crisis that has swept the nation. These agreements are a critical component of our comprehensive efforts to provide homeowners with the resources and assistance they need to remain in their homes,” Secretary Perez said.
As delinquency and foreclosure rates have climbed across the nation, homeowners seeking alternatives have had increasing difficulty even getting their loan servicer on the phone, let alone accessing meaningful loss mitigation. Recognizing this troubling trend, Governor O’Malley called servicers to the table in February to find a way to ensure more Marylanders have access. The agreements announced today are a result of months of negotiations.
"Maryland's agreements with servicers will enable our network of HOPE housing counselors to work more closely with lenders to provide more options for Marylanders to mitigate foreclosure," said DHCD Secretary Raymond A. Skinner. "The efforts of the housing counselors have been incredible, and a better relationship with the servicers will surely help increase positive outcomes for our State's homeowners."
The O’Malley-Brown Administration has also undertaken other efforts to ensure servicers do their part in Maryland to preserve homeownership. The State enacted an emergency regulation to collect loss mitigation data from servicers. The data has shown that while more delinquent homeowners are receiving loss mitigation services now than they were six months ago, the number of delinquent homeowners continues to grow.
In addition to the steps taken today, Governor O’Malley, Administration officials and the General Assembly have worked aggressively over the past year and a half to address what has become the worst housing crisis the nation has seen since the Great Depression. Governor O’Malley has signed into law legislation that The Washington Post called “among the most sweeping in the country” to keep families in their homes, including legislation that:
Lengthened the foreclosure process to approximately 150 days, providing homeowners with more time and notice before a foreclosure sale;
Made mortgage fraud a crime for anyone involved in the mortgage transaction and punishable by fine or imprisonment;
Reformed lending practices by banning pre-payment penalties on mortgage loans, requiring lenders to verify a borrower’s ability to repay a loan and strengthening the licensing requirements for mortgage professionals.
Governor O’Malley also announced the “Bridge to HOPE” Loan Program, which provides small gap loans at zero percent interest to homeowners facing difficulty, giving them time to get back on their feet or find a solution. Families and individuals facing the possibility of foreclosure should call 1-877-462-7555 or visit www.MDHOPE.org for assistance. He also launched the “Mortgage Late? Don’t Wait!” campaign, a comprehensive, multimedia advertising campaign to help tackle rising foreclosures in the State and ensure Maryland homeowners are aware of the programs available to provide assistance and relief.
Servicers are also now subject to a duty of care, which requires them to promptly respond to homeowners seeking timely help and information about their mortgage loan accounts. Servicers must also pursue loss mitigation where possible. Maryland is the first state in the nation to enact such a duty for loan servicers.
“This new regulation makes clear that servicers with a Maryland license will be held to a standard of care that reflects best practices in the industry and is responsive to consumers,” Commissioner Raskin said.
The agreements announced today add an additional tool to the arsenal the State has developed to preserve homeownership in Maryland. Housing Counselors and pro bono attorneys who are part of the Foreclosure Prevention Assistance Network, and accessible through the HOPE Hotline, will now have better access to servicers. This latest development is part of Maryland’s long term, comprehensive efforts to combat foreclosures, protect homeowners and preserve communities.

With more and more homeowners facing
foreclosure in Maryland, Governor Martin
O’Malley recently signed into law a number
of measures to give homeowners protections
and keep them from losing their homes to
foreclosure.
These laws are intended to protect you from
fraud, and to give you more time to find
solutions and avoid foreclosure.
For many homeowners, the idea of foreclosure
is so devastating, they ignore the situation and
wait to do anything until it’s too late.
If you are having trouble making your payments,
or if you’re facing foreclosure, DON’T
WAIT! Contact your lender immediately.
The Foreclosure Process
 On April 4, 2008, Maryland’s new foreclosure
process became law.
 Under the new law, your lender must send
you a notice of their intent to foreclose
at least 45 days before filing a foreclosure
action in court.
 A foreclosure action cannot be filed in
court until at least 90 days after you
default on your loan.
 You must be personally served with court
papers when the foreclosure action is filed.
If your lender tries to personally serve you
the papers but is unsuccessful, the lender
may serve you the papers by posting them
on your property and mailing them by
certified mail.
 Your lender must wait 45 days after you
are served with the court papers before
selling your home at auction.
 Your lender must publish a notice of sale
in a newspaper three times before the sale
takes place.
 You have the right, up until one business
day before the auction, to pay any overdue
payments, late fees and charges to stop the
foreclosure sale.
Fraud and Scams
 Mortgage fraud is a serious crime in Maryland.
Mortgage fraud can include any
misrepresentation or omission of information
during the mortgage process. Anyone
who commits mortgage fraud can be fined
or sent to jail .
 You have the right to sue those who commit
fraud against you during the mortgage
transaction.
 Beware of situations that involve someone
advertising, sending an e-mail, or coming
to your door offering a “way out” or
“rescuing you from foreclosure.” These
“rescue scams” are illegal.
 Example: A person will tell you, the only
way to avoid foreclosure is to sign over the
deed to your home. They will say that you
can remain in the home as a renter, and
buy it back later. In reality, they strip your
home of its equity and stop making payments.

Announces Legislative Package, New Regulations, and
‘Bridge to Hope’ Loan Program to Help Homeowners
LANDOVER, MD (January 14, 2008) – Governor Martin
O’Malley today announced new legislation and emergency regulations and initiatives to help thousands of Maryland homeowners at risk of losing their homes and to prevent future generations of homeowners losing their homes due to foreclosure following the sub-prime mortgage crisis facing our entire nation today.
The Governor was joined by Lieutenant Governor Anthony Brown, Department of Labor, Licensing and Regulation Secretary Thomas Perez and Department of Housing and Community Development Secretary Raymond Skinner, and many local elected officials and community leaders in Prince George’s County to roll out a comprehensive package of initiatives and reforms aimed at addressing the drastic rise in foreclosures in Maryland.
“Homeownership is the cornerstone of the American dream and the building block of a stronger and growing middle class,” said Governor Martin O’Malley. “But thousands of homeowners in Maryland and across our nation, through no fault of their own, have fallen victim to fraudulent schemes and scams by dishonest lenders and brokers in the wake of the sub-prime mortgage crisis facing our nation. The proposals we are announcing today will help those families at risk of foreclosure, and create greater protections for future homeowners. These initiatives will also serve as a reminder for those in the mortgage industry that we will not stand by while Maryland’s middle class families fall victim to irresponsible, deceptive, and predatory lending practices.”
“Governor O’Malley and I believe that a government of the people ought to work for them,” Lt. Governor Brown said. “Too many Marylanders are being punished through no fault of their own and we intend to protect working families from losing their homes to sub-prime markets and predatory lenders.”
Last year, Governor O’Malley created the Homeownership Preservation Task Force to develop recommendations on how to help Maryland homeowners, reform lending practices, lengthen the
foreclosure process to make it fairer, and crack down on fraud and unscrupulous practices in the mortgage industry.
Foreclosure rates have risen dramatically across the nation, and Maryland has not escaped the trend. From the 3rd Quarter of 2006 to the 3rd Quarter of 2007, foreclosure events in Maryland increased by 639 percent. The climb is expected to continue this year as many of the adjustable rate mortgages issued in recent years reset to higher interest rates. It is estimated that 33,000 Maryland homeowners are expected to face interest rate resets this year.
The package of initiatives announced today includes the “Bridge to HOPE” Loan Program, which will provide small gap loans at zero percent interest to homeowners facing difficulty, giving them time to get back on their feet or find a solution. The statewide program will be administered by the Maryland Department of Housing and Community Development’s Community Development Administration (CDA).
“The Bridge to HOPE will literally provide hope to hundreds of Maryland homeowners,” said Secretary Raymond A. Skinner. “We want to ensure that homeownership is protected and sustainable in Maryland. Through partnerships with housing counseling agencies throughout the state, we will implement practical solutions to foreclosure challenges.”
Governor O'Malley also announced today an emergency regulation that will make Maryland the second state in the country to require loan servicers to file detailed monthly disclosure reports about their loss mitigation and loan modification efforts. The reports will outline the precise nature and extent of the actions being taken to assist homeowners who have defaulted on loans.
“There are thousands of Marylanders on the verge of foreclosure and we need information now to learn what actions servicers are taking to prevent foreclosure,” Secretary Perez said. “Data collection and reporting is a critical accountability tool that only one other state, California, has in place.”
Governor O’Malley’s legislative package and regulatory proposals include: The legislative and regulatory proposals include bills that will:

Improve the regulation of mortgage industry professionals and reform lending practices by:

Banning pre-payment penalties for sub prime loans;
􀂾
Assuring a borrower’s ability to repay a loan and verify sources of income; and
􀂾
Increasing the mortgage licensing requirements, including the surety bond requirement for mortgage lender licensees and institute a minimum net worth requirement.

Create a criminal mortgage fraud statute that covers all potential actors engaged in mortgage fraud.
􀂙
Modify the Protection for Homeowners in Foreclosure Act (PHIFA), which was passed in 2005, by banning the conveyance of real property in the foreclosure rescue context.

Reform the foreclosure process by:
􀂾
Requiring a lender to wait 90 days after default before filing the foreclosure action;
􀂾
Sending a uniform Notice of Intent to Foreclose to the homeowner 45 days prior to filing an action; and
􀂾
Requiring personal service to notify a homeowner of impending foreclosure and require that a sale may not occur for 45 days after service.

Reform lending practices in Maryland by:
􀂾
Requiring a duty of good faith and fair dealing for mortgage industry professionals;
􀂾
Requiring brokers and lenders to show a reasonable net tangible benefit for borrowers when refinancing;

Tracking rates of default and foreclosure of mortgage industry professionals; and
􀂾
Strengthening the experience requirement to obtain a license.
