In fact MediaTakeOut.com suspects that Chris Brown will likely serve less than a year in prison for the assault against Rihanna – and he may get off completely!!

Many people in the media are speculating that Chris Brown will be brought up on felony domestic battery charge – but HE WON’T!! MediaTakeOut.com discovered that, under California law, Chris Brown CAN NOT be charged with domestic battery. That’s because the domestic battery law only applies to “a spouse, former spouse, cohabitant, former co-habitant, or the mother or father of his or her child.” Since Chris and Rihanna don’t live together (Chris has continuously maintained his own apartment), aren’t married, and don’t have a child together – the law doesn’t apply.

So that means that the district attorney’s best chance to prosecute Chris is under the “Crinimal Threat” charge. But according to TMZ, that might not work either. Here’s what they’re reporting:

During [Rihanna and Cris’] argument, he started hitting her. According to the police report, she ordered him to drive her home and "faked a call" to someone, saying things like "He's dropping me off. Make sure the cops are there."

Rihanna told cops the fake call enraged Brown. He said something to the effect of "You are really fu**ed up now. I'm going to kill you." This statement is the basis of the criminal threats charge. … As one law enforcement source told us, "It's kinda weak, and the D.A. is not going to prosecute a high profile case like this unless it's solid."

That means that Chris Brown will likely only be charged with simple assault (a misdemeanor that carries a 6 month jail time) or misdemeanor domestic violence. Either way, given the fact Chris is a first time offender, and that people close to Chris tell MediaTakeOut.com that Rihanna was actively involved in the scuffle – it may be difficult for the prosecution to make any assault charge stick.

	Chris will probably receive nothing more than probation and counseling. At the same time, however, Rihanna needs to be ordered into some type of anger management counseling herself. Chris is a first-time offender, he's not a menace to society, and there is no threat that he's going to go out and whoop 15 more bytches' azzes. These grown azz repeate offenders deserve second chances, but 19-year-old, 1st-time offender Chris Brown should be thrown under the fukkn jail? I'm confused. They both should be ordered to receive help, and Chris should be put on probation. 	No matter how the story goes or who started what, CHRIS BROWN IS A WOMAN BEATER. He swelled up a woman’s eye BECAUSE OF WORDS. He cannot be a man, yet. But, now that things are coming into light I realize that Chris’ actions created his own domino effect, so in Chris brought this upon himself. And, Rihinna is indeed a victim more than once and this is only a sign of what’s more to come. Last but not least, there are so many women that are really in the same situation but prefer the lifestyle that is being presented. Even recently Juanita Byum was attacked by a Christian husband…so in the real world women know what’s up with their man…they are really stuck. I’m sure it is difficult to avoid the depths and timeframe of an abusive situation. So, Rihanna’s going to most likely go back and forth with Chris in and out of love, but my point is that there are many Rihannas and Chris Browns. Also, I’ve been listening to the Russ Parr morning show and he’s been talking about abuse in relationships and that most African Americans do not speak up because they are conditioned to believe that family business is family business. But when abuse is involved it is actually very important to speak up, get help to out, and stay away from the situation, etc. All in all, I’m sure it’s pretty hard, mentally and emotionally.

Criminal threats carries a maximum of 9 years in prison while domestic violence carries less of a sentence. If Chris Brown is a first time offender the prosecutor is unlikely to throw the book at him as you suggest she should. In most instances when a defendant has a knowledgeable attorney, that attorney will be able to argue downward from whatever the prosecutor is seeking on behalf of the state. In this instance its not likely to be attempted murder - not even close! I would hazard a guess that if the case is not thrown out – Chris will end up with several years of probation and community service of some sort. I think I understand your overall point that – “young black defendants should understand the seriousness of their offenses and be willing to pay the price”. However, in every instance the punishment SHOULD be proportionate with the offense. Moreover, in this instance a sentencing judge is likely to look at Chris’s career, any good deeds he’s done in the past and his individual capacity to add to the “betterment” of society in the long haul. What greater good would be met by incarcerating a Chris Brown if probation and community service is appropriate? He’s a “positive” young man contributing to his community.

I’m not calling you racist. Nor am I suggesting that you agree with the above. However, your “positions” on sentencing or making an example of are used against brown and black men everyday. This is why so many black attorneys and judges I know fought hard to have the sentencing between crack cocaine and powdered cocaine “justified”. Historically, one only needed to be carrying a small amount of crack cocaine to get say 5 years minimum (usually an inner city black man). Alternatively, one could have an ounce of powdered cocaine and receive probation or 1 year (usually a middle class white suburban male). I just think we all need to be careful about how we approach the criminal justice system. It is innately biased toward persons of color. This does not justify fools and their bad behavior. However, it does mean that we should be careful about what we wish for when it comes to the prosecution of positive young black men.

If the many media reports about the alleged altercation on Sunday between Chris Brown and girlfriend Rihanna are to be believed, she suffered a serious assault from her 19-year-old boyfriend. While police have not named the victim in the case or released details of the assault, a number of media outlets have cited sources who said that Rihanna was the victim and that she suffered serious injuries. Brown was arrested on Sunday and booked on suspicion of making criminal threats in what has been described as a domestic-abuse incident that was the culmination of a reportedly troubled relationship with an alleged history of previous abusive incidents. Based on comments MTV News has received on the incident, a surprising number of people — some of whom are apparently female, although screen names often aren't gender-specific — are blaming Rihanna for the alleged incident. For example, "I don't think Chris would just a hit a girl like that," wrote reader Nika2hot. "She had to do something or say something out the way for him to really hurt her." "Blaming the victim has gone on as long as I can remember, both in sexual assault and domestic violence," said Kim Gandy, the president of NOW, the National Organization For Women. "When I started working on domestic-violence issues in the 1970s, women would not come forward because they knew they would be blamed, no matter how blameless they knew they were. Maybe they hadn't ironed his shirt right, or burned the toast, or 'done something' to justify being beaten." Gandy said progress has been made since then, but the cycle of violence has continued, and in fact, has been on the upswing among teens over the past decade. "Domestic violence has been going on for so long, and it's such a part of our culture, on TV and in movies, that it's easy to say, 'She must have done something to deserve it.'
