An article you guys posted the other day about one of Brown's friends said they shared an apartment together. I'm no attorney, but that sounds like cohabitant to me. thanks you for taking the time to write a thoughtful and provocative lil' piece there. I know many women that were abused too, and fortunately I havent been one of them. When you witness that kind of thing first hand you learn to intuit it and I think a alot of women misjudge or ignore the signs of someone who AINT RIGHT.
Up until the I was 13, I was taller than most of the boys in my grade, I was athletic and was the girl that could kick the hell outt them red rubber balls that if you got hit with, stung like 200 bee stings. One day, I got into verbal fisticuffs with some dimwit that escalted and I gave him a swift uppercut to the gut. Hard. In front of his boys. They laughed. Now, I’m afraid that this event has sent two public messages:
1.) the law will never apply therefore may not be able to aid this situation if it’s ongoing – but (you never know) next time could be deadly 2.) and people at the top are treated differently than people at the bottom, for sure.
Anyway, until I heard the entire story, I did not support Rihanna because she literally affected Chris’ finances overnight. But, now that things are coming into light I realize that Chris’ actions created his own domino effect, so in Chris brought this upon himself. And, Rihinna is indeed a victim more than once and this is only a sign of what’s more to come.
Last but not least, there are so many women that are really in the same situation but prefer the lifestyle that is being presented. Even recently Juanita Byum was attacked by a Christian husband…so in the real world women know what’s up with their man…they are really stuck. I’m sure it is difficult to avoid the depths and timeframe of an abusive situation. So, Rihanna’s going to most likely go back and forth with Chris in and out of love, but my point is that there are many Rihannas and Chris Browns.
Also, I’ve been listening to the Russ Parr morning show and he’s been talking about abuse in relationships and that most African Americans do not speak up because they are conditioned to believe that family business is family business. But when abuse is involved it is actually very important to speak up, get help to out, and stay away from the situation, etc.

He is going to get off because of the fact that Rihanna had more to do with it then she is letting on and when she finally comes clean about what REALLY happened, she could get into trouble too. The loophole for domestic battery might be true, but there is still assault & battery which is a totally different charge. Or, they may just charge him with assualt by itself if it is found out he put hands on. A "criminal threat" is just verbal. If there is evidence of "hands on", they will have to charge him more harshly.

"Domestic violence" is abuse perpetrated against any of the following persons: (a) A spouse or former spouse. (b) A cohabitant or former cohabitant, as defined in Section 6209. (c) A person with whom the respondent is having or has had a dating or engagement relationship. (d) A person with whom the respondent has had a child, where the presumption applies that the male parent is the father of the child of the female parent under the Uniform Parentage Act (Part 3 (commencing with Section 7600) of Division 12). (e) A child of a party or a child who is the subject of an action under the Uniform Parentage Act, where the presumption applies that the male parent is the father of the child to be protected. (f) Any other person related by consanguinity or affinity within the second degree."
Furthermore, here's another reference of California's laws: "California enacts AB 2250 (Speier) which, among other things, redefines "domestic violence" to include abuse committed against an adult or a fully emancipated minor who is a spouse, former spouse, domestic partner or a person with whom the suspect has had a child or is having a or has had a date or engagement. In addition, this bill also provides that a "domestic partner" means a person who is having or has had a consensual sexual relationship and lives with, or has lived with, the suspect. (Penal Code 13700 & 13730) (1993) (California Department of Justice)"
So, it doesn't look like there actually is a loophole in the law and he CAN be charged with Domestic Violence.

whoever made the legal analysis on california law is wrong and it is a shame how misinformation is continuously passed around. This is exactly what the Cali penal code says:

When a battery is committed against a spouse, a person with whom the defendant is cohabiting, a person who is the parent of the defendant's child, former spouse, fiance, or fiancee, or a person with whom the defendant currently has, or has previously had, a dating or engagement relationship, the battery is punishable by a fine not exceeding two thousand dollars ($2,000), or by imprisonment in a county jail for a period of not more than one year, or by both that fine and imprisonment.
So under these circumstances Chris could be charged with domestic battery because he and Rihanna have (had) a dating relationship.
People, think about it he's charged with criminal threats,everyone is reporting on ALLEGED abuse, if he had beat her wouldnt the charge be assault and battery? thumbs1: The charges they bring you on first are usually the ones that carry the highest sentence. Criminal threats carries a maximum of 9 years in prison while domestic violence carries less of a sentence. The DA is going to decide sometime next week whether to charge him with more (domestic violence, etc) and he more than likely will.

PLEASE stop the speculation. If there was physical evidence that Rhianna had been physically assaulted then C Brown would have been charged with assault and battery no if's, ands, or buts. The DA would not need any more proof. The fact that he was charged with making a threat is her word against his therefore, the DA is telling the cops I cannot build a case with this little evidence; find proof that he said this or I can't waste the taxpayers money prosecuting this. I am sooo serious. There is PROOF that Michael smoked (a picture is worth a thousand words). You see the charges against Chris seem to be reduced everyday and at this point neither side has told what "really" happened so we don't know what the truth is. Wrong is wrong whichever way you slice it. Whether it is battery or smoking week, both acts are illegal regardless of who it harms. According to your logic, the question becomes is it better that kids look up to a woman beater or a weed head, if indeed kids view them as role as role models?

If Chris Brown is a first time offender the prosecutor is unlikely to throw the book at him as you suggest she should. In most instances when a defendant has a knowledgeable attorney, that attorney will be able to argue downward from whatever the prosecutor is seeking on behalf of the state.
In this instance its not likely to be attempted murder - not even close ........................................... I agree with your assessment in regards to what he will likely get. And not in the “traditional” since. He attempted to steal a car. In the process of pulling off with the stolen car, the owner of the car attempted to stop him by jumping on the hood of the car.
Balfour continued in his theft, with the owner/victim on top of the car. Ultimately, he crashed, and the owner of the car was injury. Somehow, our system of justice found a way to convict William Balfour of “attempted murder’ and he served 7 years in prison. If prosecuters want you, they can also find “loopholes” to prosecute. Look at how they did OJ Simpson this time around. I learned about a whole new concept as it relates to “kidnapping”. lol

First of all CB needs help, he was also a victim of abuse by his stepdad and he should really get some therapy before he gets into another relationship. Rhianna needs therapy too, there is never one big isolated incident when it comes to abuse, it often starts off slowly and then escalates. Whatever happens, he needs therapy more than jail. That part of the story about Chris getting vexed when she made the call doesn't make sense either. Cause if they were arguing and he started hitting her as the story above claims, which would have cause her to get those "horrific injuries"that the media claims, how she get to be making a phone call?????? Wasn't she too bruised and battered? Oh wait no wasn't she unconscious too?? Too many versions of the story and it is just getting ridiculous.
