: It appears that the pressure may have been too much for B2K's Raz B. In a video that appeared on YouTube last night, Raz B recanted his abuse allegations against Chris Stokes.
Here is a transcript of what he said:
My name is DeMario Thornton, publicly known as Raz B of B2K. I would like to send a public apology for some tapes that were leaked without my authority. And I just want to say that those allegations are not true with Chris Stokes and Marques Houston.And I apologize for any hurt that this may cause publicly [or] financially.

This story has taken us through so many twists and turns, it's hard to know what to think.
We'll keep you up to date on any new developments in the case...

This is some ish if ever there was any. As far as I am concerned this kid was threatened, paid off or worse. Take a look at the video...someone is clearly feeding him what to say...you can hear them. You can hear them say "Chris Stokes." There is no way in hell that someone else leaked this tape or that Raz made this ish up. We heard exactly what went down and what went down was some serious allegations of abuse and a CONFESSION from Mr. Chris Strokes.
Raz's mistake was that Chris had him on the taped recording issue. Permission was needed. I'm not mad at him though...had he not recorded this ish, he would not have had as much credibility as he did. As it is, there are a bunch of dumbfucks who don't understand a confession when they hear one and Chris' lame excuse for that statement solidified that his ass confessed.
Who exactly does this kid have...a crack head mother and a devastated suicidal brother who was also molested by this predator? He folded or was threatened and many of us will always know the truth.
Bottom line...Chris, Marques and Omarion...your careers just went POOF!!! The damage is done. I will be writing MTV, VH1 and BET and they had better not allow a reality series to go forward. I'm sorry but i think Raz was telling the truth. i think he was stepped to in a way that made him recant. But just because he recanted, doesn't mean that the authorities aren't still investigating!!! i hope they are and if it turns out to be true, i hope he gets what he deserves. i have 3 sons and that's some nasty sh*t!!! that goes to show you that you have to be very careful who you leave your kids with.

It's evident that you've never been a victim of abuse. I am far from being naive. And your statement is elementary at best. This entire ordeal is about so much more than money and or someone being paid off. It's deeper. Grown men don't expose themselves as victims, risk vulnerability and ridicule by bloggers/media outlets for MONEY. This recanted story is about FEAR. That new video was forced and as unsincere as one could be. Raz and Ricky are dealing with childhood wounds that have not healed and therefore were crying out for help.
This story is not comparable to the Duke case. That was a story of cry wolf which is not applicable to Raz B and his brother. I don't expect Marques Houston, Omarion nor the rest of B2K to stand up along side Raz. They are too worried about their own futures in the industry than telling the truth.

Again, if this was initially about money, how come neither he or his brother approached Chris first? That's usually how a shakedown for money works, isn't it? Take a look at Chris' MTV interview posted yesterday where he admits that the first time he heard about these allegations was when he saw the video. Also, at the end of the video, Chris offers to meet with them to talk things out..and guess what..they decline. If they were doing this to try to get back on Chris' payroll, they would have agreed to meet with him quick, fast and in a hurry.
Based upon these facts, if this were about money look at what Raz B's plan would have had to have been. His plan would have had to have been to air out his dirty laundry in the most public of ways, admit that he was anally abused from the age of 11 through his teens by another man...a family member no less...and just for kicks, I guess he decided to throw in that he participated in masturbating and performing oral-sex on his band-mates, took showers with them and engaged in orgies with them...oh yeah...let's not forget that he stood to make money from a reality series that according to MTV is off the table right now due to these allegations. Now, just for giggles, he went as far as to say that his ass hurt. Now, just in case that weren't enough, his own damn brother basically admitted that he sent his own flesh and blood into the lion's den. If we are to beleive that this was always about a potential big pay off, then we would have to believe that Raz B did all of this in the hopes that either one of two things would happen:
a) Chris would be sooo embarrassed once these allegations came out that he would give him a huge pay day. Now of course, all of this could have been accomplished by simply approaching Chris in the first damn place with the tapes and making plenty of copies. He would have saved himself the embarrasment, gay accusations and public humiliation.

b)Raz B was smart enough to look forward to a potential civil trial. First of all, we would have to assume that the statute of limitations has not run. Assuming that he could still sue civilally, Raz B opted to go this routeso that he could really and truly emasculate himself, subject himself to depositions, cross-examination, public scrutiny about his past criminal record and alleged bi-polar disease as well as sit through the denials that any fool could see would be forth-coming from his band-mates and Marques Houston. Now, assuming he survived a civil trial,although with no admissable evidence to corroborate his claims because the damn tape would not be admissible since he did not have Chris' or Marques' sisters permission that would be very unlikely, assuming by the grace of God he won, exactly how many years down the road do you think he would see this money? Oh yeah...let's not forget the appeals process.
Sorry...the only reason this kid came forward was because it in fact happened. Chris stole his manhood, his childhood and his money.

Raz B look very scared to me and would not look into the camera. He either was paid or threaten by Chris and his crew to recant his story about being molested by Chris. Money talks! He was telling the truth but he really has no one to witness with him. Omarion, Marques and anybody else who are still working aren't going to soil their reputation by admitting how they really got put on! Plus, it is illegal to tape a phone conversation without the other person's consent. What proof could he really provide? If he doesn't have pictures, he is just a$$ out! The boy was trying to be hard in the first video but it is obvious that he doesn't have a strong will nor is he terribly bright. And in some Black families especially, this type of thing is seldom talked about and is considered dirty laundry. That young man is a classic victim. Also no one knows what happened ... so there could be proof of the rape/molestation. If there was tearing or bleeding, it could have very well not been reported but he could have gone to a doctor and said it happened some other way .. also people are assuming this happened ONCE ....not !!!! also .... he Raz could be examined today .... if there were tears to his rectum, there is scar tissue there no matter how microscopic ... and old scar tissue can be distingushed from that which is recent... It can also be determined approx when the tearing took place as the body heals differently at different rates at different ages and before and after puberty ... so Lets just watch it unfold.

As I said yesterday, Chris dug himself into a deep friggin hole by continually yaking about the incident. He made a statement that is posted on MTV and offered an explaination for his "confession." He said that he was referring to his supposedly "not financially supporting Thornton and his brother." Please tell me how "I don't do that anymore. That was me years ago ...I just don't do that in my life anymore" is in any way referring to his not supporting these kids when he admitted in the same interview that up until very recently he was basically their sole means of support!!!

I soo believe that was definitly what happened. And not just that, but when the reality of the cost of fighting this guy in court (because it is clear he has not financial ability to do it)it and he (Chris) intimidated him. This is not the first time A VICTIM has recanted, and it wont be the last.

BTW...the taped recording took place in California where it is illegal to tape someone without their permission. In the MTV interview, Chris said that he and Marques' sister were in the process of suing Raz B for taping the convo...hence...I think...his statement that the tapes were leaked without his permission.

The only reason why he recanted his statements is because he recorded all parties involved without their knowledge. That is a federal crime, and he would be facing serious time in prison because of that. 1. Molesters prey on the kids with issues, missing parent, covicted parent, mental issues and many other reasons because said child lacks stability and no one is there for him/her. Molestation didn't occur at the time of the crime it began from the very first time the child was in the company of said molester. 5. Most children of sexual abuse behavior conduct themselves negatively after the abuse because it's a form of acting out. So if Raz had convictions after the age of 11 that would explain it. Wasn't he in B2K at the time - & the need to commit a crime was for what? If he is Bi-Polar sexual abuse could have been the trigger, etc... 6. Most children of sexual abuse DO NOT discuss it, whether it's a male or female child. Usually something will trigger a memory like: the birth of their own child, or running into the abuser many years later. 7. During the abuse many children "have an outer body experience' as to deflect from the abuse. The mentally go where no one has gone before.

This is exactly why I am a FIRM believer in education! Parents need to get themselves together and stop living off of and pimping out their kids. These boys have a lot of pressure on them. I think RazB was in hiding.......they found him and made him record this video. That's what it looks like to me. Raz B recanted his statements because he recorded all parties involved without their knowledge. That is a federal crime, and he would be facing serious time, especially if they have high powered attorneys who will bury you with that charge. I don't know what the truth is, but if Raz B is lying about someone molesting him then I would sue his ass for slandering my name under false pretenses. In a 30-second video posted on YouTube on Wednesday, Thornton stands outside on a city street and recants the sordid accusations he and older brother Ricardo "Ricky Romantic" Thornton had made in a pair of videos that circulated over the weekend.
"This is DeMario Thornton, publicly known as Raz-B of B2K," a solemn-looking Thornton tells the camera in the video, called "The Truth About Chris Stokes B2K Part 3." "I would like to send a public apology for some tapes that were leaked without my authority. I just want to say that those allegations are not true ... with Chris Stokes and Marques Houston, and I apologize for any hurt this may have caused publicly [or] financially."
Stokes reacted to the new video in a statement released Thursday (December 27) morning. "I'm happy that DeMario 'Raz-B' Thornton and Ricardo Thornton realized their mistakes and admitted to lying," he said. "I have always supported my family and have always been a stand-up person. I knew that the truth would eventually come to light."
Thornton's abrupt turn-around came just hours after Stokes told MTV News that the allegations were false. His denials were seconded by another former B2K member, Omarion.
"I'm not gay. And I'm married. And I have four kids. I been with my wife for 16 years," Stokes told MTV in an exclusive interview. "And I'm not a child molester. So those are all false allegations. I'm gonna sue them. And I owe that to my wife and kids, period. It's ridiculous."
The truce between Raz and Stokes doesn't appear to have been extended to Ricardo. After MTV reported on the apology, Ricardo told MTV News that he stands by all the original allegations and is not recanting his story. He said he hasn't spoken to his younger brother in more than a day — which he said was unusual for the siblings #8212; and predicted that Raz will "come back around," suggesting that the apology might not have been his brother's idea.

I truly pray that RazB is okay. They may try to kill the boy and make it look like he commited suicide. So much has been going on surrounding this entire incident. Omarion has now apparently decided to speak out. Omarion said: Chis has been nothing but a father figure to the B2K folks and that he’s never seen him behave inappropriately. He says Chris is married to his aunt and he knows Chris very well. It is very interesting that all of these suspect molestation allegations.
It is also being said that the LAPD is investigating Chris Stokes about the allegations brought upon him. He is also planning to take legal action as well as revenge if Raz B and his brother Ricky Romance doesn't stop what he calls "lying."
We have a direct quote from Raz himself who said "Chris wants me to make a statement, but I didn't lie. I wouldn't lie about something like that."
There is also an eyewitness report from an extremly reliable source that we will not disclose that Chris Stokes was seen in a car with Marques Houston franticlly yelling and screaming at him and looking as if he was going to hit him.
K, so I saw the video(s) w/ Raz B and heard what is supposedly Chris in the background and a few things jump out on me. 1 - You can clearly hear him saying that "that isn't my life anymore" which to me is as close to an admission of guilt as anything else. 2 - No nicca, especially in the industry, would come out and say he was molested if he wasn't involved in gay activities with another man. 3 - Oh boy, Raz B, looks hella sad...like he had a life full of hurt. If he is lying...and I don't believe he is, this nicca is a future Oscar winner..real talk. My whole thing w/ being gay is do what you do but do it with another grown a$$ man...leave this kids alone and allow them the freedom to make their own way in life (sexually). Raz-B’s allegation of child molestation doesn’t seem far-fetched. In an October 2006 interview, he stated:
“I am hosting a benefit concert at the Apollo Theater in October. [¶1] A jury found Appellant Mark Stokes guilty of taking “immoral” liberties with a sixteen-year-old girl in violation of Wyo. Stat. Ann. § 14-3-105 (LexisNexis 2005). In this appeal, Stokes challenges the constitutionality of that statute. We affirm.
ISSUE
[¶2] Stokes offers the following issue for our review:
Whether Wyo. Stat. § 14-3-105 is unconstitutionally vague.
FACTS
[¶3] The essential facts of this case are not in dispute. AJ, the victim in this case, was a sixteen-year-old junior in high school when she met Stokes in the fall of 2004. At the time, AJ was dating Stokes’ younger brother. Eventually, Stokes, who was then twenty-one years of age, and AJ began dating. Sometime around the end of October or early November 2004, AJ’s mother (hereinafter “Mother”) learned of their relationship, and she confronted them. Mother told both AJ and Stokes that Stokes was too old for AJ and she did not want them to date under any circumstances. Stokes agreed to discontinue dating AJ until she turned eighteen years of age.
[¶4] Despite Mother’s demands to terminate the relationship, Stokes and AJ continued to see each other. In early December 2004, Stokes and AJ decided to take their relationship to the next level. On two occasions, Stokes and AJ had sexual intercourse at Stokes’ apartment. When Mother found out she reported the matter to police. Upon questioning by police, Stokes described his relationship with AJ as boyfriend and girlfriend and admitted to having sexual intercourse with AJ on two occasions. Stokes also acknowledged that he knew he was doing something wrong when he had sex with sixteen-year-old AJ, and that he broke the rule by getting involved with someone under the age of eighteen.
[¶5] Stokes was arrested and charged with one count of taking immodest, immoral or indecent liberties with a child. At the conclusion of a one-day trial, the jury returned a special verdict finding Stokes guilty of taking immoral liberties with AJ and not guilty on the alternative acts of immodest and indecent liberties.1 The district court sentenced Stokes to three to five years imprisonment but suspended execution of that sentence in favor of probation. This appeal followed.
STANDARD OF REVIEW
[¶6] We review constitutional questions de novo. Rabuck v. State, 2006 WY 25, ¶ 13, 129 P.3d 861, 864 (Wyo. 2006); Giles v. State, 2004 WY 101, ¶ 10, 96 P.3d 1027, 1030 (Wyo. 2004). Because Stokes did not raise the issue of the constitutionality of Wyo. Stat. Ann. § 14-3-105 in the district court, our review of Stokes’ claim is confined to a search for plain error. Plain error exists when: (1) the record is clear as to the incident alleged as error; (2) the error transgressed a clear and unequivocal rule of law; and (3) the error adversely affected a substantial right of the accused which materially prejudiced him. Moe v. State, 2005 WY 58, ¶ 7, 110 P.3d 1206, 1210 (Wyo. 2005); Pierson v. State, 956 P.2d 1119, 1123 (Wyo. 1998).
DISCUSSION
[¶7] This Court is once again asked to review the constitutionality of Wyoming’s indecent liberties statute, Wyo. Stat. Ann. § 14-3-105 (LexisNexis 2005), which states in pertinent part:
(a) Except under circumstance[s] constituting sexual assault in the first, second or third degree as defined by W.S. 6-2-302 through 6-2-304, any person knowingly taking immodest, immoral or indecent liberties with any child or knowingly causing or encouraging any child to cause or encourage another child to commit with him any immoral or indecent act is guilty of a felony. . . .

(c) As used in this section, “child” means a person under the age of eighteen (18) years.
Like others before him, Stokes contends the statute is unconstitutionally vague, both “facially” and “as applied” to his conduct. Stokes complicates our review of his claim by merging his facial challenge with his “as applied” challenge. Regardless, we reject his constitutional challenges.
[¶8] A statute is facially vague if it reaches a substantial amount of constitutionally protected conduct or if it specifies no standard of conduct at all. Moe, ¶ 9, 110 P.3d at 1210; Giles, ¶ 15, 96 P.3d at 1031. On numerous occasions this Court has considered and soundly rejected facial vagueness challenges to § 14-3-105. See Moe, ¶¶ 10-11, 110 P.3d at 1210-11; Giles, ¶¶ 15-19, 96 P.3d at 1031-33; Schmidt v. State, 2001 WY 73, ¶ 28, 29 P.3d 76, 85 (Wyo. 2001); Pierson, 956 P.2d at 1123-24; Moore v. State, 912 P.2d 1113, 1114-16 (Wyo. 1996); Lovato v. State, 901 P.2d 408, 412 (Wyo. 1995); Ochoa v. State, 848 P.2d 1359, 1363 (Wyo. 1993); Griego v. State, 761 P.2d 973, 975-76 (Wyo. 1988); Sorenson v. State, 604 P.2d 1031, 1034-35 (Wyo. 1979). Stokes’ argument offers nothing new that compels us to reconsider our prior holdings on this issue.
[¶9] We now turn to Stokes’ contention that § 14-3-105 is unconstitutionally vague as applied to him. When a statute is challenged on an “as applied” basis, we must determine whether the statute provides sufficient notice to a person of ordinary intelligence that his conduct was illegal and whether the facts of the case demonstrate arbitrary enforcement. Rabuck, ¶ 16, 129 P.3d at 865 (citing Lovato, 901 P.2d at 412; Griego, 761 P.2d at 976). In determining whether a statute provides sufficient notice, we consider the statutory language, any prior court decisions that have construed the statute, and whether the statute has been previously applied to substantially identical conduct. Rabuck, ¶ 16, 129 P.2d at 865; Giles, ¶ 23, 96 P.3d at 1035; Griego, 761 P.2d at 976. “If the statute has been previously applied to conduct substantially identical to that of the appellant, he cannot complain notice was lacking.” Saiz v. State, 2001 WY 76, ¶ 13, 30 P.3d 21, 26 (Wyo. 2001) (footnote omitted).
[¶10] Stokes complains that the statute is vague in that it does not describe with particularity what acts are forbidden. As a consequence, it was only after the jury rendered its verdict that he understood his acts to be criminal conduct. This is the same argument that was presented to this Court in Giles. The majority of this Court found such argument to be unpersuasive:
Giles argues that § 14-3-105 fails to describe with particularity what acts are considered criminal because it relies on undefined terms. Thus, Giles asserts that he was afforded inadequate prior notice that the acts in which he engaged constituted a violation of the indecent liberties statute. . . . Giles contends that it was only after the jury passed judgment in his case, based on the undefined terms of “immoral,” “immodest,” and “indecent,” that he could have understood that his acts constituted criminal conduct. Upon consideration, we reject Giles’ argument.
Giles, ¶ 20, 96 P.3d at 1033-34.
[¶11] Stokes’ contention that the statute fails to provide sufficient notice that his consensual sexual relationship with sixteen-year-old AJ was prohibited conduct under the terms of the statute is not well taken. This Court has held that the meaning of the terms “immoral,” “immodest,” and “indecent” is sufficiently clear. See Rabuck, ¶ 17, 129 P.3d at 865; Pierson, 956 P.2d at 1123; Sorenson, 604 P.2d at 1034-35. Further, consensual sex with a sixteen-year-old has previously been determined to violate the statute. See Moe, ¶¶ 12-13, 110 P.3d at 1211; Pierson, 956 P.2d at 1123-24; Moore, 912 P.2d at 1114-16; McArtor v. State, 699 P.2d 288, 292-94 (Wyo. 1985). Although Stokes briefly mentions the lack of an extreme age difference as a mitigating factor, Stokes admitted that he understood that his conduct was wrong and that he should have waited until AJ was eighteen years of age. Under these specific circumstances, and in the absence of any evidence that the statute was enforced in a discriminatory manner, we have no hesitation in holding that § 14-3-105 is not vague as applied to Stokes’ conduct in this case.
[¶12] Affirmed.
