If he rejects it, solely, it can come up again. This way it will never come up again because the highest court as ruled that it has no grounds.

There! That link should explain that this is all no big deal. This is how the court works. There was no "petition" by Clarence Thomas, it is a petition by the plaintiff. Every Justice has a jurisdiction that they are responsible for. This fell under his responsibility.

This election system is so flawed. You have the elcetion, the people vote, the popular votes are counted (don't even get me started on the electoral college crap), the results are announced, and the President is officially elected. And then the Supreme Court has to meet a month later to certify the election? What kind of mess is this? What's the point of President-Elects going through the process of picking people for cabinet positions if you still have to wait to see if the Supreme Court justices don't have an axe to grind?

Both urge the court to consider claims that President-elect Obama is not qualified to be president, because he is not a natural-born American citizen.
Persistent concerns about the qualifications of both major party candidates rank among the oddest aspects of 2008's historic campaign.
Article II, Section 1 of the Constitution provides that "No person except a natural born citizen" is eligible to be president. John McCain's status was questioned because he was born in the Panama Canal Zone and various theories have been advanced to cast doubt on Obama's.
Lawsuits over the inclusion of their names on state general-election ballots popped up around the country and were quickly dispensed with by local courts. But two challengers have pursued their cases to the Supreme Court.
Pennsylvania lawyer Philip Berg claims that the circumstances of Obama's birth are vague and that he may have been born in Kenya. Obama's mother, Berg asserts, later flew to Hawaii to register the birth.
Leo Donofrio, a New Jersey lawyer, contends that election officials in his state failed to ensure that only legally qualified candidates were placed on the ballot. Obama may have been born in the United States, Donofrio argues, but "natural born" status depends on both parents being American citizens. Obama's father was Kenyan.
The justices are unlikely to take up these cases for a host of reasons, not the least of which is the invitation to overturn the results of an election in which more than 66 million Americans voted for Obama. A child born outside of the United States to one U.S. Citizen parent and one non-U.S. Citizen parent, may be entitled to citizenship providing the U.S. Citizen parent had, prior to the birth of the child, been physically present in the United States for a period of ten years, at least five years of which were after s/he reached the age of fourteen.

The United States Constitution requires that Presidents (and Vice Presidents) of the United States be natural born citizens of the United States. While it is undisputed that people born in the US are qualified to hold the office of President, and that naturalized U.S. citizens are disqualified from holding that office, it is disputed whether people born to US-citizen parents outside the United states are natural born citizens or not.[1]

The 1790 Congress, many of whose members had been members of the Constitutional Convention, provided in the Naturalization Act of 1790 that "And the children of citizens of the United States that may be born beyond the sea, or out of the limits of the United States, shall be considered as natural born citizens." In addition George Washington was president of the Constitutional Convention and President of the United States when this bill became law. Obama did not present the proper documentation to the senate. according to what i have been reading he produced a birth certificate via his campaign which in turn went online..this process prompted suspicion and made it appear as though he had something to hide. The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.
The governor's office in Hawaii said he had a valid certificate but rejected requests for access and left ambiguous its origin. Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii.
Obama's half-sister, Maya Soetoro, has named two different Hawaii hospitals where Obama could have been born.
But a video posted on YouTube features Obama's Kenyan grandmother Sarah claiming to have witnessed Obama's birth in Kenya.

This all came about when the Republic party knew they were going to lose this election. If I am not mistaken, President Obama in deed presented document to prove that he was indeed a born US native. As for as Judge Thomas, he has been the most critical of blacks then any of the other judges on that panel. Blacks have stood behind Judge Thomas and his radical actions for a long time and he always seem to be a let down.

This past presidential season I saw a renewed enthusiasm from our country’s youth.
An excitement for liberty gripped the college campuses unlike I have ever seen before. Young people were energized for real change.
Still to my amazement, our college rallies attracted thousands of young people. Students were hungry for the message of freedom, peace, and prosperity.
For this reason, a youth-based movement for liberty is essential to our cause. It is these young men and women who will become tomorrow’s champions of liberty.

I voted for Obama..and could care less..but the argument has been raised, and you have to be fair.. over 100,000 people signed a petition to see something a little more ligitimate than this certificate of birth. They are ssying that the authentic document can be requested by him through vital records at a cost of 12.00. He should present that to the courts or the United states senate, the same way that the other presidential candidates did, and this will shut down the argument..as it did for the others. the question is ...why won't he do that? this is why the controversy is ongoing... and getting out hand! If you want to see them, get the court order and permission, pay the fee, and be happy with that.

yeah..i got home late that night and read over the comments. I responded. Basically, what happened was, our local DJ broke it down on the radio..basically saying that they booked these ladies as last minute picks. they almost did not go ahead with them.,,but none of the really wealthy women would do it. He went on to say that they had even asked his wife..and she said no. Many of the wives could not do it because their husbands said no. In my humble opinion it is not up to Obama to prove that he was born in the U.S. It is up to his detractors to prove that he wasn't. When you are a new born you are not aware of anything around you. You could be told that you were born on the moon. How would you know any differently. There is no way Obama can verify something that that was the result of himself being born. Show evidence that he was born elsewhere and then get back with me.

The person who originally submitted the petition actually submitted to remove Obama ( had a dual citizenship US & Britain), McCain ( Born in Panama Canal Zone when it was in US possesion )and the person who ran for the Socialists workers party ( he was born in Nicaragua) candidate as well. this petition was killed so he went and sent it to the justice in his area and his petition was killed there as well. Legally he can resubmit it to another justice and resubmitted it to Thomas, of course Thomas could have turned down his petition BUT then he could have just resubmitted to another justice. Pundits are thinking Thomas has submitted to his co- justices more to HAVE EVERYONE VOTE THE PETITION DOWN THEN PERMENANTLY KILL THE PETITION 4EVER ,that way we dont have to hear from this guy ever again

There might be a possibility that no one really knows where his real birth certificate is. I know that might sound a little crazy because he is the president but think about it. He was raised by his grandparents becuase his mother couldn't raise him, it could have gotten mixed up in all the craziness back in the day. It is hard gettin a copy of your birth certificate if you don't have the right documents.

For the record, Cynthia McKinney petitioned to debate both Obama and McCain but because the Democratic and Republican parties are just flip sides to the same coin and have their hands in the pockets of the major networks, it didn’t happen. They know she would have asked the real questions just as she has in the past when it comes to 9/11 and Hurricane Katrina and she will continue to do so. McKinney was going to call for the impeachment of both Bush and Chenney.
There are a lot of people both on and off line that were not aware you can write in a candidates name on a ballot. If you were aware of that, then congratulations to you. You have a little more knowledge than most. That was not a “cheap shot” as you called it or my way of “coming at you” for not voting for McKinney. You are free to vote for whom ever you want to vote for. You say you were able to relate to Obama and I was not.
The fact of the matter is, a lot of people did vote for Obama just because he is of Kenyan heritage. My own uncle who sadly had never voted before a day in his life only registered and voted because Obama was running and it nothing to do with the issues, it was all about skin color.
Because I did take the time to research Cynthia McKinney and where she stood on different issues, my vote was not based on skin color.

Someone is lying. According to Obama's Kenyan (paternal) grandmother, as well as his half-brother and half-sister, Barack Hussein Obama was born in Kenya, not in Hawaii as the Democratic candidate for president claims. His grandmother bragged that her grandson is about to be President of the United States and is so proud because she was present DURING HIS BIRTH IN KENYA, in the delivery room. -This, according to several news sites and Pennsylvania attorney Philip J. Berg (see video below) who is, surprisingly, a life long democrat himself. Berg is the former Deputy Attorney General of Pennsylvania, and he has an impressive background in his activities as a democrat, but his support for the party seemingly stops when it comes to his trust in Barack Hussein Obama.
Many U.S. voters are suspicious of the Democratic candidate's past, and Berg filed a lawsuit to force Barack Hussein Obama to produce a certified copy of his original birth certificate to prove that he can run for the office of President of the United States. However, he is being fought. The DNC On Sept. 24 filed a motion to dismiss the Berg action. Why? What is there to hide? Why not produce the original birth certificate and be done with all the suspicions against Barack Hussein Obama?
A few months back, a birth certificate WAS posted on the internet which shows that Obama was born in Hawaii. Yet some say this birth certificate is a forgery and again, his grandmother states that she was present at the birth, in Kenya. So what is the truth?
One explanation is that Obama's mother Ann Dunham, flew to Kenya in 1961 with Obama's father to meet his family. According to some news reports, Ann Dunham, was not accepted well by her husband's family because she was white:
"Obama's family did not take to Stanley Ann Dunham Obama very well, because she was white, according to Sarah Obama. Shortly after she arrived in Kenya Stanley Ann decided to return to Hawaii because she later said, she did not like how Muslim men treated their wives in Kenya. However, because she was near term the airline would not let her fly until after the birth of her baby. Obama's grandmother said the baby—Barack Hussein Obama, Jr.—was born in Kenya and that shortly after he was born, Stanley Ann returned to Hawaii."
However, by the time she wanted to leave Kenya, it was during the late stages of her pregnancy. She was not able to board a plane because the airlines wouldn't allow women so close to birth to fly. It is instead believed, that Barack Hussein Obama was born in Kenya as his grandmother apparently stated. Then, after he was born, his mother returned with him to Hawaii where his birth was REGISTERED on or about August 8th, 1961, in the public records office in Hawaii.
There is also a discrepancy in what hospital Barack Hussein Obama was born in, even if he was born in Hawaii. Reports by his own sister in two separate interviews state that he was born at two different hospitals-- Kapiolani Hospital and Queens Hospital--in Honolulu.
The Times Herald even reports: "the senator's grandmother, brother and sister, who live in Kenya, believe they were present during Obama's birth in the African country." Here, the Times Herald uses the word that his family 'believe' he was born in Kenya (perhaps to avoid possible law suits by Obama's Truth Squad?).
I myself, not wanting to believe what I see, did some searching around, and this is what I came up with:
Obama was born on August 4, 1961, at the Kapiolani Medical Center.
and here it says:
Barack Obama was born at the Queen's Medical Centeron 4 August 1961.
So which hospital was it, or was he really born in Kenya? And why is this simple matter so confusing and disturbing? Do the search your self and plug in these key words:
Obama born Queen's Medical Center and then Obama born Kapiolani Medical Center in a Google search. You will see he is reported to be born in two diferent hospitals. A miracle! Maybe he IS the Messiah (grin).
What's so hard about knowing something so simple as which hospital or country someone was born in? And if it is simple, then why doesn't Barack Hussein Obama just present the court with his original birth certificate to be analysed and proven? The onus of proof is on him, not the American public of which he wants their trust in him to be their leader.
So, who is lying? Barack? His grandmother? His sister? Someone is.

@girlsluvgems: Bill O'Reilly's viewers asked him to research quite a few things on Obama and he did. The birth certificate was one of them and he found no truth whatsoever of Obama being born outside of the U.S.
As for Obama's Kenyan family, his father had so many children and wives that his grandmother probably can't remember which birth she attended. That man loved to make babies and have wives and abandoned them all!
With Obama's father being in Hawaii in school then abandoning them when he was only 2, I don't believe for a minute his mother got a chance to spend any time in Kenya.

Then they went to Hawaii and that's where they discovered the bulk of his teen life.

bill Oreily only let it go beccause the courts threw it out and he did not want to deal with it because it is a bit complicated. the bottom line is..The lawsuit challenges the qualifications of Barack Obama to serve as president of the United States based on whether he is a "natural born citizen" as defined in the Constitution. the fact that the court will have to decide this or look at this is embarrasing. news articles through out the web state that privacy laws prevent Hawaii from releassing his records without his consent or without his request. He has not and will net give his consent . this is a problem... and is suspect at best. but because his mom is a citizen, some laws say he is ok. bu the constitution says he is not ok, based on the meaning for natural born citizen. her citizenship is not enough when it comes to defining qualifications for president.
... and just to clear up some possible confusion, the Constitution does NOT require Representatives or Senators to be NATURAL BORN citizens of the USA. Only the offices of President and Vice-President have that restriction. To be a Senator, you only have to be a NATURALIZED citizen who has lived in the USA at least seven years (and you have to be 30 years of age or older). A Representative must be at least 25 years of age and have been a NATURALIZED citizen and resident for at least five years. So just because Obama was elected to the US Senate does NOT mean that anyone would have needed to question his citizenship, since he is/was indeed NATURALIZED in 1961.
In closing i will say...defining natural born citizen as it is outlined in the constitution is very complex because our forefathers were not very clear. some say it means born in the usa ..while others believe one or both parents are citizen thus AS I said....John McCain, was born to Navy parents in Panama. but because it was on American territory, like Guam and Puerto Rico scholar and expert said it was ok in the end per the the U.S. Senate resolution examination of his birth certif and the laws at that time. OBama never cooperated in the way that McCain did..never produced the authentic certificate, and never went before the senate. But any way, in the end, like i said , the champagne is chlled, the roast duck is on the menu, the inauguration is in full effect, so the Supreme Court is likely to say Mr. Obama's birth was OK, too. Mr Obama has been arrogant and suspect.. about the matter (is my main point), But..this has been a nice debate, and we'll see what happens on tomorrow when the court reviews everything.

The only question that might have come up when he was elected a Senator was whether he was old enough and whether he had lived in the USA for at least seven years and whether or not he was a US citizen. He was found to be a citizen, he was old enough and he lived here for at least seven years. Done. That's a little different than the qualifications for President.

Obama's citizenship is NOT related to his ethnic background... I wouldn't care if he were purple. If he wasn't born in this country, then he cannot assume the office of President. It's really pretty simple. What does bother almost as much is the utter Oh-my-Gawd-he-is-the-ONE mentality of some supporters. Seems to me there was a country named Germany that had that same problem back about 1938. There were a lot of blacks, whites, yellows and reds and all backgrounds in between that died supporting our Constitution - and we owe them the respect of making sure that terms of the Constitution are adhered to.

I have not been following Obama or his campaign enough to know the ins and outs of his birth, citizenship or lack there of but it is refreshing to see people so passionate about it and I certainly learned some things I did not know.
I do believe yesterday I called for people to get back into the Constitutional fold of government. We can not pick and choose who gets rights and who doesn’t or which laws we want to uphold and which ones we don’t. You can not stampede on one man’s civil rights and then get angry when yours are violated.

I think ya'll [EXPLETIVE] are silly. This issue of his citizenship came up at the very beginning of his announcement that he would run. It even came up for McCain. But the constitution states that you can not be a president not that you can not run. I think Barack is a good guy, definitely the best of the people who made it through the "primaries" but not the best person who ran...and if you didn't vote in the the "primaries" you probably don't understand the process well enough to comment. I think people should make sure the Constitution is upheld, remember Barack doesn't want anyone to have any guns, neither does Biden, these are Constituional rights. Bush has ruined our legar right to privacy. Know your facts we don't have much of the Consitution left.
Also, I wasn't a big Barack supporter though he is much better than McCain in his ability to relate to people, his policies are another story. But I think if you want to be all upset about a Supreme Court Justice upholding the Constitution and reviewing a case that has been filed against Obama in many states prior to now, I think you should be more upset that more [EXPLETIVE] who are not mixed and are actually descended from slaves were not in position to run. Not just in Congress or in the Senate, as we have rich white people who run all the time. Why do [EXPLETIVE] have to settle to the chitlin's Massa gave them? Why wasn't our first president descended from parents from Detroit and Watts? Jacksonville and D.C.? Or Memphis and Atlanta? Actually, not all of the presidents were "white" because two or three where mulattos, and our very first president was a Moor ("black") by the name of John Hanson. George Washington was the 9th president.
Not every "black" person in America is a descendent of Africans brought over here in the slave trade. Most are the descendents of the Moors that were already in this country that became prisoners of war (slaves).
