Have you heard of the Constitution? It would be a violation of Fantasia's 14th Amendment aka Due Process right to a trial if the plaintiff could present a case and she automatically be liable. You are confusing presumption for liability. If the wife can prove she is married then there is a presumption that Fantasia knew but it is definitely not an irrebutable presumption.

I work in the legal profession in NC (more info. than you need to know, MTO) and this law is called "conversion" or "alienation of affection" and YES, you can and SHOULD sue for it if indeed you find out cheating hubby's jump-off is aware that he's married. Most people who pursue these charges during a divorce usually ONLY do so when the third party is aware of the marital status of the other person and still went on to have an affair with the married party. Sucks but it sure is a deterrent to cheat - here, anyway! Not.worth.it!

Last Day on the Job It was the mailman's last day on the job after 35 years of carrying the mail through all kinds of weather to the same neighborhood.

One little problem with your story MTO. The party neing sued has to be bound by the law. Since that's probably over you guys head, it means the accused must maintain a residence in the state where the law applies. If the man was smart and rally loved Fantasia, he would protect her by going back to his wife for 4 or 5 months (since most wives are desperate enough to take a man back).
