Yenny Valero, 31, of Astoria, says that her son was attacked in a bathroom in Public School 112 before the end of the school year last June. He was 5 at the time.Four fellow kindergartner boys held the victim down, removed his pants and violated the boy with at least one finger into his anus, according to Valero.
"My son still can't sleep and he is very anxious, even though he is going to therapy," said Valero, who had the boy transferred after the incident.
The boy suffered permanent physical and psychological injuries from the attack, according to Valero's suit.
Police were called in to investigate the incident after it occurred, but detectives dropped the case because of the young age of the children involved.
School officials also investigated the incident, but they were unable to prove that the attack occurred.
Valero's lawyer Julio Portilla insists that the shocking attack happened, even though authorities were unable to substantiate the boy's claims.
"The school failed in its duty and now they are trying to sweep it under the rug," said Portilla, who filed legal papers in Queens Supreme Court over the summer.

My mother has been tell my siblings abduction i stories like this since forever. This isn't uncommon. When she was a child in the 70s and 80s she often heard stories about younger boys being forced into stuff in locker rooms and bathrooms. At the juvenile she works at, they hold kids that young for sexual assault. I don't know much about New Yorks justice system, but in Texas they don't play that regardless of age. Tyc is full of young predators. There's always some type of punishment.
Smh.... Imagine the stories that are not in the newspapers....
But this is what happens when you live in a society that puts shows on the air like Toddlers and Tiaras and not expect for things to be all screwed up. And I'm not saying that shows like that are the sole reason because media has been reckless for years. It's only now that people have become numb or insensitive to life as a whole. Then again, some people have become a little too sensitive over the years as well. We, as a people, have become displaced and out of harmony with the essence of our existence. F**k getting swagger back, we need to get our spirits back. And I'm not talking about through the institution of religion that has been accepted by the world, although that is a start, it is by no means the only answer.
But I only know what works for me, so I'll just leave things at that.

It was probably whites kids responsible and that's why nothing was done. That is learned behavior and should be investigated because someone has probably done that to at least on of those young attackers. That fact alone should warrant some kind of further investigation by the "detectives" but that may take a little work and asking white men to actually do their jobs can be difficult. So in this case a little Latino boy gets no justice.
@bigdeal500 unfortunately age isn't the only factor in cases like these. Poverty and ignorance know no age. I know far too many stories that don't make the news. One example, my friend called me hysterical saying my son touched her daughters "cooter" and that he said let me see it. We took him straight to therapy even tho it sounded suspect. My son doesn't use words like that and at 4 he has yet to discover sexuality. The therapist did her tests and determined it wasn't true. Soon there after this girl was talking about humping and asking what penis were. Come to find out she would be in the room when her mother had sex. Smh
This is sad cause NOTHING can be done about it, The kids just simply DONT know any better & arent even mature enuff to have a sexual identity. Even most str8 men have had homosexual tendencies at around 6 through 10 b4 hitting puberty. I just hope the little boy/victim can FORGIVE these boys cuz they just dont know any better.
I believe that this this kind of stuff happens so much because so many women are letting any old hood rat live them and leaving them alone with their children. There are people that do horrible things kids and then kids teach the crap to other kids. Quti calling rats pedophiles 'YO MAN'! Gett a real working man who pays bills and sets a good a example. Or, keep them legs closed long enough to raise your raise your kids right or don't have them!

Instead of blaming the school they need to see how the other boys are living because young kids dont do that for no reason maybe they are getting raped at home by thier fathers.. And thats something that the school has no control over what people want teachers going with little boys into the bathroom then there would be an issue with that smh parents need to take responsbility and poor little boy tho..
